Usted declara y garantiza que (i) la información de la tarjeta de crédito que proporciona es verdadera, correcta y completa, (ii) está debidamente autorizado para utilizar dicha tarjeta de crédito para la compra, (iii) los cargos incurridos por usted serán aceptados por la compañía de su tarjeta de crédito, y (iv) pagará los cargos incurridos por usted a los precios publicados, incluidos los cargos de envío y manipulación y todos los impuestos aplicables, si los hubiera.

Los métodos de pago aceptados pueden incluir PayPal y tarjetas de crédito o débito elegibles, incluidas Visa, Mastercard, American Express y Discover, según se muestre durante el proceso de pago. Estos Términos le permiten utilizar los Servicios únicamente para su uso personal y no comercial. No debe reproducir, distribuir, modificar, crear obras derivadas, mostrar públicamente, ejecutar públicamente, volver a publicar, descargar, almacenar o transmitir ningún material de los Servicios sin nuestro consentimiento previo por escrito. Salvo lo expresamente dispuesto en el presente documento, nada de lo contenido en estos Términos otorga ni deberá interpretarse como el otorgamiento de una licencia u otros derechos a usted bajo ninguna patente, marca comercial, derecho de autor u otra propiedad intelectual de Vaelis Tech, Shopify o cualquier tercero. Es posible que se le proporcione acceso a herramientas para clientes ofrecidas por terceros como parte de los Servicios, las cuales no supervisamos ni tenemos ningún control o participación sobre ellas.

Usted reconoce y acepta que proporcionamos acceso a dichas herramientas "tal cual" y "según disponibilidad", sin garantías, declaraciones ni condiciones de ningún tipo y sin ningún respaldo. No tendremos responsabilidad alguna derivada o relacionada con su uso de herramientas opcionales de terceros.

Cualquier uso que usted haga de las herramientas opcionales ofrecidas a través del sitio es completamente bajo su propio riesgo y discreción, y debe asegurarse de conocer y aprobar los términos bajo los cuales las herramientas son proporcionadas por los proveedores terceros correspondientes.

También podemos, en el futuro, ofrecer nuevas funciones a través de los Servicios (incluido el lanzamiento de nuevas herramientas y recursos). Dichas nuevas funciones también se considerarán parte de los Servicios y estarán sujetas a estos Términos de Servicio.

SECCIÓN 8 - ENLACES DE TERCEROS

Los Servicios pueden contener materiales e hipervínculos a sitios web proporcionados u operados por terceros (incluida cualquier funcionalidad de terceros integrada). Asimismo, acepta que sus Comentarios no contendrán contenido difamatorio o de otro modo ilegal, abusivo u obsceno, ni contendrán virus informáticos u otro malware que pueda afectar de cualquier manera el funcionamiento de los Servicios o cualquier sitio web relacionado. No puede utilizar una dirección de correo electrónico falsa, hacerse pasar por otra persona o inducirnos a nosotros o a terceros a error respecto del origen de cualquier Comentario. Usted es el único responsable de cualquier Comentario que realice y de su exactitud. No asumimos ninguna responsabilidad ni obligación por los Comentarios publicados por usted o por terceros.

SECCIÓN 12 - ERRORES, INEXACTITUDES Y OMISIONES

Ocasionalmente puede haber información en los Servicios que contenga errores tipográficos, inexactitudes u omisiones que puedan estar relacionadas con descripciones de productos, precios, promociones, ofertas, cargos de envío de productos, tiempos de tránsito y disponibilidad. Nos reservamos el derecho de corregir cualquier error, inexactitud u omisión, y de cambiar o actualizar información o cancelar pedidos si cualquier información es inexacta en cualquier momento sin previo aviso (incluso después de que usted haya enviado su pedido).

SECCIÓN 13 - USOS PROHIBIDOS

Puede acceder y utilizar los Servicios únicamente para fines legales. No puede acceder ni utilizar los Servicios, directa o indirectamente: (a) para ningún propósito ilegal o malicioso; (b) para infringir cualquier reglamento, norma, ley u ordenanza local, provincial, estatal, federal o internacional; (c) para infringir o violar nuestros derechos de propiedad intelectual o los derechos de propiedad intelectual de otros; (d) para acosar, abusar, insultar, dañar, difamar, calumniar, menospreciar, intimidar o perjudicar a cualquiera de nuestros empleados o a cualquier otra persona; (e) para transmitir información falsa o engañosa; (f) para enviar, recibir conscientemente, cargar, descargar, utilizar o reutilizar cualquier material que no cumpla con estos Términos; (g) para transmitir o procurar el envío de cualquier material publicitario o promocional, incluido cualquier "correo basura", "cadena", "spam" o cualquier otra solicitud similar; (h) para hacerse pasar o intentar hacerse pasar por cualquier otra persona o entidad; o (i) para participar en cualquier otra conducta que restrinja o inhiba el uso o disfrute de los Servicios por parte de cualquier persona, o que, según determinemos, pueda perjudicar a Vaelis Tech, Shopify o a los usuarios de los Servicios, o exponerlos a responsabilidad.

Además, usted acepta no: (a) cargar o transmitir virus o cualquier otro tipo de código malicioso que se utilice o pueda utilizarse de cualquier manera que afecte la funcionalidad o el funcionamiento de los Servicios; (b) reproducir, duplicar, copiar, extraer, vender, revender o explotar cualquier parte de los Servicios; (c) recopilar o rastrear la información personal de otros; (d) enviar spam, realizar phishing, pharming o pretexting en los Servicios; (e) utilizar cualquier robot, spider, herramientas de scraping, recopilación y extracción de datos, dispositivos o procesos automáticos, herramientas de IA (como IA agéntica) o medios automáticos o manuales para acceder a los Servicios; o (f) interferir, eludir o sortear las funciones de seguridad o autorización, encabezados de exclusión de robots u otras medidas que empleemos para restringir el acceso a los Servicios. Nos reservamos el derecho de suspender, deshabilitar o cancelar su cuenta en cualquier momento, sin previo aviso, si determinamos que ha infringido cualquier parte de estos Términos.

SECCIÓN 14 - AGENTES

14.1 Esta sección ("Términos de Agentes") se aplica si usted utiliza, permite, habilita o provoca la implementación de un Agente para acceder, utilizar o interactuar con cualquier Servicio. "Agente" significa cualquier software o servicio que realiza acciones autónomas o semiautónomas en nombre de, o siguiendo las instrucciones de, cualquier persona o entidad y que puede ejecutarse en nombre de una persona o utilizando su dispositivo, sin supervisión directa.

14.2 Ningún Agente puede acceder, utilizar o interactuar con los Servicios a menos que, en todo momento, se identifique y opere en estricto cumplimiento de los requisitos establecidos en la sección 14.4 a continuación. Además, ningún Agente puede acceder, utilizar o interactuar con los Servicios si hemos solicitado que el Agente se abstenga de acceder, utilizar o interactuar con cualquier servicio.

14.3 Podemos limitar, incluso mediante medidas técnicas, si un Agente puede acceder, utilizar e interactuar con los Servicios y de qué manera.

14.4 Los Agentes deben: (i) en todas las solicitudes HTTP/HTTPS, identificar que la solicitud proviene de un Agente y revelar el nombre del Agente incluyendo lo siguiente en la cadena de agente de usuario de la solicitud: "Agent/[nombre del agente]"; (ii) no ocultar ni disimular que cualquier acceso, uso o interacción proviene de un Agente, por ejemplo, (a) imitando el comportamiento humano y los patrones de interacción, o (b) completando o eludiendo CAPTCHAs o medidas destinadas a distinguir el uso informático del humano; (iii) responder con veracidad a cualquier pregunta o indicación destinada a determinar si las interacciones provienen de un humano o de una computadora; (iv) no eludir ni evitar de cualquier otra manera ninguna medida destinada a bloquear, limitar, modificar o controlar si los Agentes pueden acceder, utilizar o interactuar con los Servicios y de qué manera.

SECCIÓN 15 - TERMINACIÓN

Podemos rescindir este acuerdo o su acceso a los Servicios (o a cualquier parte de ellos) a nuestra entera discreción en cualquier momento y sin previo aviso, y usted seguirá siendo responsable de todos los importes adeudados hasta la fecha de terminación inclusive.

Las siguientes secciones seguirán siendo aplicables después de cualquier terminación: Propiedad Intelectual, Comentarios, Terminación, Exclusión de Garantías, Limitación de Responsabilidad, Indemnización, Divisibilidad, Renuncia; Acuerdo Completo, Cesión, Ley Aplicable, Política de Privacidad y cualquier otra disposición que, por su naturaleza, deba continuar vigente después de la terminación.

SECCIÓN 16 - EXCLUSIÓN DE GARANTÍAS

La información presentada en o a través de los Servicios se proporciona únicamente con fines de información general. No garantizamos la exactitud, integridad o utilidad de esta información. Cualquier confianza que usted deposite en dicha información será estrictamente bajo su propio riesgo. Renunciamos a toda responsabilidad derivada de cualquier confianza depositada en dichos materiales por usted o cualquier otro visitante de los Servicios, o por cualquier persona que pueda ser informada de cualquiera de sus contenidos.

SALVO QUE VAELIS TECH LO INDIQUE EXPRESAMENTE, LOS SERVICIOS Y TODOS LOS PRODUCTOS OFRECIDOS A TRAVÉS DE LOS SERVICIOS SE PROPORCIONAN "TAL CUAL" Y "SEGÚN DISPONIBILIDAD" PARA SU USO, SIN NINGUNA DECLARACIÓN, GARANTÍA O CONDICIÓN DE NINGÚN TIPO, YA SEA EXPRESA O IMPLÍCITA, INCLUIDAS TODAS LAS GARANTÍAS O CONDICIONES IMPLÍCITAS DE COMERCIABILIDAD, CALIDAD COMERCIAL, IDONEIDAD PARA UN PROPÓSITO PARTICULAR, DURABILIDAD, TITULARIDAD Y NO INFRACCIÓN. NO GARANTIZAMOS, DECLARAMOS NI ASEGURAMOS QUE SU USO DE LOS SERVICIOS SERÁ ININTERRUMPIDO, OPORTUNO, SEGURO O LIBRE DE ERRORES. ALGUNAS JURISDICCIONES LIMITAN O NO PERMITEN LA EXCLUSIÓN DE GARANTÍAS IMPLÍCITAS U OTRAS GARANTÍAS, POR LO QUE LA EXCLUSIÓN ANTERIOR PUEDE NO SER APLICABLE A USTED.

SECCIÓN 17 - LIMITACIÓN DE RESPONSABILIDAD

EN LA MÁXIMA MEDIDA PERMITIDA POR LA LEY, EN NINGÚN CASO VAELIS TECH, NUESTROS SOCIOS, DIRECTORES, FUNCIONARIOS, EMPLEADOS, AFILIADOS, AGENTES, CONTRATISTAS, PROVEEDORES DE SERVICIOS O LICENCIANTES, NI LOS DE SHOPIFY Y SUS AFILIADOS, SERÁN RESPONSABLES DE NINGUNA LESIÓN, PÉRDIDA, RECLAMACIÓN O DAÑO DIRECTO, INDIRECTO, INCIDENTAL, PUNITIVO, ESPECIAL O CONSECUENTE DE NINGÚN TIPO, INCLUIDOS, ENTRE OTROS, PÉRDIDA DE GANANCIAS, PÉRDIDA DE INGRESOS, PÉRDIDA DE AHORROS, PÉRDIDA DE DATOS, COSTOS DE REEMPLAZO O CUALQUIER DAÑO SIMILAR, YA SEA BASADO EN CONTRATO, RESPONSABILIDAD EXTRACONTRACTUAL (INCLUIDA NEGLIGENCIA), RESPONSABILIDAD OBJETIVA O DE OTRO TIPO, QUE SURJA DE SU USO DE CUALQUIERA DE LOS SERVICIOS O DE CUALQUIER PRODUCTO ADQUIRIDO UTILIZANDO LOS SERVICIOS, O POR CUALQUIER OTRA RECLAMACIÓN RELACIONADA DE CUALQUIER MANERA CON SU USO DE LOS SERVICIOS O DE CUALQUIER PRODUCTO, INCLUIDOS, ENTRE OTROS, CUALQUIER ERROR U OMISIÓN EN CUALQUIER CONTENIDO, O CUALQUIER PÉRDIDA O DAÑO DE CUALQUIER TIPO INCURRIDO COMO RESULTADO DEL USO DE LOS SERVICIOS O DE CUALQUIER CONTENIDO (O PRODUCTO) PUBLICADO, TRANSMITIDO O PUESTO A DISPOSICIÓN DE CUALQUIER OTRA MANERA A TRAVÉS DE LOS SERVICIOS, INCLUSO SI SE HUBIERA ADVERTIDO DE SU POSIBILIDAD.

SECCIÓN 18 - INDEMNIZACIÓN

Usted acepta indemnizar, defender y mantener indemnes a Vaelis Tech, Shopify y a nuestros afiliados, socios, funcionarios, directores, empleados, agentes, contratistas, licenciantes y proveedores de servicios frente a cualquier pérdida, daño, responsabilidad o reclamación, incluidos honorarios razonables de abogados, pagaderos a cualquier tercero debido a o derivados de (1) su incumplimiento de estos Términos de Servicio o de los documentos que incorporan por referencia, (2) su violación de cualquier ley o de los derechos de un tercero, o (3) su acceso y uso de los Servicios.

Le notificaremos cualquier reclamación indemnizable, siempre que la falta de notificación inmediata no lo libere de sus obligaciones salvo que resulte sustancialmente perjudicado. Podemos controlar la defensa y resolución de dicha reclamación a su cargo, incluida la elección de abogado, pero no resolveremos ninguna reclamación que le imponga obligaciones no monetarias sin su consentimiento (que no podrá ser denegado de manera irrazonable). Usted cooperará en la defensa de las reclamaciones indemnizadas, incluso proporcionando documentos relevantes.

SECCIÓN 19 - DIVISIBILIDAD

En caso de que se determine que alguna disposición de estos Términos de Servicio es ilegal, nula o inaplicable, dicha disposición seguirá siendo aplicable en la máxima medida permitida por la legislación aplicable, y la parte inaplicable se considerará separada de estos Términos de Servicio; dicha determinación no afectará la validez y aplicabilidad de ninguna otra disposición restante.

SECCIÓN 20 - RENUNCIA; ACUERDO COMPLETO

Los encabezados utilizados en este acuerdo se incluyen únicamente por conveniencia y no limitarán ni afectarán de ninguna otra manera estos Términos.

Nos reservamos el derecho, a nuestra entera discreción, de actualizar, cambiar o reemplazar cualquier parte de estos Términos de Servicio publicando actualizaciones y cambios en nuestro sitio web. Es su responsabilidad revisar nuestro sitio web periódicamente para comprobar si existen cambios.
